Terms and Conditions

These Terms of Service (“Terms”) govern your access to and use of the websites, programs, courses, content, and services operated by Andrea Stenberg Consulting (“Company,” “we,” “us,” or “our”), including https://www.thebabyboomerentrepreneur.com/ (the “Site”) and any related pages, groups, communities, events, webinars, downloads, and coaching (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Services.

1) Who We Are
We provide education and coaching for coaches, healers, and heart-centered entrepreneurs, specializing in video marketing, trust-building content, and visibility strategy. Offerings include online courses, live workshops/webinars, digital downloads, group programs, and 1:1 consulting.
2) Eligibility
You must be at least the age of majority in your province/territory (18 in Ontario) or have parental/guardian consent. You represent that you have the authority to enter these Terms. You may not use the Services if prohibited by law.
3) Accounts & Access
You may need an account to access certain features. Keep your login secure and do not share it. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
4) Purchases, Payments, Taxes
Prices are shown in the currency indicated at checkout and may change without notice. Payment is processed by third-party processors (e.g., Stripe, PayPal, course platforms). You authorize us and our processors to charge your payment method for all purchases, including applicable taxes. You are responsible for any taxes, duties, or fees required by your jurisdiction.
5) Refunds & Cancellations
Unless a specific product page or order confirmation states otherwise:
Digital downloads and templates: Non-refundable once delivered/accessed.
Courses, workshops, and group programs: Refund policy (if any) will be stated on the sales page and/or checkout. If no policy is stated, sales are final.
1:1 services/consulting: Cancellations/rescheduling require reasonable notice as specified in your service agreement or confirmation email; unused sessions expire at the earlier of the program end date or 6 months from purchase unless otherwise stated.
Chargebacks are not an alternative to our refund process. You agree to contact us to resolve billing issues before initiating a chargeback.
6) License to You
Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services and to use purchased content for your personal or internal business use only. Unless expressly permitted, you may not share, resell, redistribute, sublicense, publish, or make the content available to third parties (including clients) beyond fair, incidental use.
7) Intellectual Property Notice
All text, videos, scripts, graphics, logos, trademarks, and course materials—is owned by and property of Andrea Stenberg, or the properly attributed party and protected by Canadian and international IP laws. No rights are granted except as expressly stated. You may not copy, modify, reverse engineer, or create derivative works without our prior written consent.
8) Your Content & Feedback
If you submit, post, or upload content (e.g., comments, testimonials, assignments, forum posts), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display such content for operating, improving, and promoting the Services. You represent that you own or have permission to share such content and that it does not infringe third-party rights. We may moderate or remove content at our discretion.
Testimonials & Wins. If you share results or a testimonial (text, audio, or video), you authorize us to use it (first name, last initial, business name, industry, and/or photo if provided) for marketing in any media. You may revoke future use by emailing us; we will make reasonable efforts to cease new uses going forward.
9) Community Guidelines
To keep our spaces supportive and safe, you agree not to:
Harass, abuse, defame, or harm others.
Post illegal, infringing, or confidential content.
Share another member’s content or course materials outside the program without permission.
Advertise or solicit within our communities unless expressly allowed. We may suspend or terminate access for violations (no refund where the violation is material or intentional).
10) Third-Party Tools & Links
We may integrate or link to third-party sites/services (e.g., Zoom, StreamYard, YouTube, social media, course platforms, payment processors). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.
11) No Professional Advice
The Services provide education and general information only and are not financial, legal, medical, psychological, or other professional advice. You are responsible for your own decisions and results. Consult appropriate professionals as needed.
12) Earnings & Results Disclaimer
We do not guarantee results, revenue, or client outcomes. Examples, case studies, and testimonials illustrate individual experiences and should not be assumed typical. Your results depend on many factors outside our control.
13) Affiliate Program & Disclosures
From time to time we may offer an affiliate program. Affiliates must comply with applicable laws and platform rules, and must clearly disclose affiliate relationships in their promotions. Commission rates, payment terms, cookie windows, and promo rules are described on the affiliate page or agreement and may change upon notice.
We may also use affiliate links to third-party products/services and may earn a commission at no extra cost to you. We only recommend resources we believe are helpful.
14) Recording & Participation
Live sessions may be recorded for educational and quality purposes. By attending, you consent to being recorded (audio/video/chat). If you do not wish to be recorded, please keep your camera off, use chat anonymously if available, or view the replay (if provided).
15) Prohibited Uses
You agree not to:
Use the Services for unlawful purposes.
Attempt to gain unauthorized access to systems or data.
Interfere with operation or security (e.g., by scraping, bots, malware).
Copy, distribute, or exploit content outside the scope of your license.
Misrepresent your identity or affiliation.
16) Termination
We may suspend or terminate your access at any time for any violation of these Terms or for behavior that, in our judgment, harms the community, our brand, or other users. Upon termination, your license ends and you must cease use of the content, except material you created independently. Sections that by nature should survive (e.g., IP, disclaimers, limitation of liability, indemnity) shall survive.
17) Warranty Disclaimer
The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
18) Limitation of Liability
To the maximum extent permitted by law, in no event shall we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits/revenues/data, arising from or related to the Services or these Terms. Our total cumulative liability for any claim shall not exceed the amount you paid to us for the product/service giving rise to the claim in the 3 months preceding the event, or CAD $100 if no purchase was made.
19) Indemnity
You agree to indemnify, defend, and hold harmless Andrea Stenberg Consulting and its owners, contractors, and affiliates from any claims, damages, costs, and expenses (including reasonable legal fees) arising from your: (a) use of the Services; (b) breach of these Terms; (c) violation of any law or third-party rights; or (d) content you submit.
20) Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to those practices, including communications related to your account, transactions, and updates. You may unsubscribe from marketing emails at any time.
21) Copyright & “Notice-and-Notice”
If you believe content on our Services infringes your copyright, please email andrea@thebabyboomerentrepreneur.com with: (a) your contact info, (b) identification of the work and allegedly infringing material (URL(s)), and (c) a statement of your rights. In Canada, the “notice-and-notice” regime may apply. We may remove or disable access to content at our discretion.
22) Changes to the Services or Terms
We may modify the Services and these Terms at any time. Material changes will be posted on the Site (and/or sent via email for enrolled users). Continued use after the effective date constitutes acceptance of the updated Terms.
23) Governing Law; Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute shall be brought in the courts of Ontario, and you consent to such jurisdiction and venue.
Good-Faith Resolution. Before commencing legal action, you agree to first notify us with a written description of the dispute and attempt good-faith resolution within 30 days.
24) Miscellaneous
Entire Agreement. These Terms and any product-specific terms or order forms are the entire agreement between you and us regarding the Services.
Severability. If any provision is unlawful or unenforceable, it will be deemed modified to the minimum extent necessary and the remainder remains in effect.
No Waiver. Failure to enforce any term is not a waiver.
Assignment. You may not assign your rights; we may assign to a successor or in connection with a sale, merger, or reorganization.
Electronic Communications. You consent to receive notices electronically.
Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.
